Terms and Conditions

By creating an account or using DaliBook's booking and payment processing services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.

If you do not agree with any part of these terms, you may not access or use our services. These terms apply to all users, including resort owners, villa managers, vacation rental operators, private home hosts, beach house owners, staff members, and guests making bookings.

DaliBook is a booking and payment processing platform designed specifically for Philippine resorts, villas, vacation rentals, private homes, and beach houses. We facilitate room reservations, booking management, payment processing, and provide comprehensive management tools with intelligent automation for resort businesses.

Our services include but are not limited to: booking facilitation, automated payment processing through third-party payment partners, resort management tools, guest tracking, occupancy-based pricing, seasonal rate management, weekend pricing automation, and operational management features with intelligent automation. Services are provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of our platform with reasonable notice to users.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when using our services, including business registration documents and contact information.

Resort partners must ensure they are duly licensed to operate hospitality businesses and have proper permits required by law. You agree to use our platform only for lawful purposes and in accordance with these terms. You may not use our platform for fraudulent, harmful, or unauthorized activities.

Our service operates on a commission-based model. We charge 12% per successful booking, which includes all payment processing fees and platform access. PayMongo Philippines Inc., our payment partner, deducts their processing fees from this 12% commission first, with the remainder being DaliBook's commission.

The PayMongo fee structure within our 12% commission varies by payment method:

• Card Payments (Visa, Mastercard, JCB): 3.5% payment processing fee + ₱15.00 fixed fee
• GCash: 2.5% payment processing fee
• Maya: 2.0% payment processing fee

Commission fees are automatically deducted from each transaction before funds are transferred to your account. Payment processing is handled by PayMongo Philippines Inc., our trusted payment partner, and you agree to comply with their terms and conditions regarding payment processing, fraud prevention, and dispute resolution. Cross-border card transactions incur an additional 1% fee on top of the 12% commission, making the total commission 13% for international payments.

A dispute fee of ₱800.00 per transaction applies to chargebacks and payment disputes. All fees are inclusive of applicable taxes including 12% VAT where required by law.

Payouts are processed weekly every Wednesday. Payment eligibility periods vary by payment method:

• Card payments: 3 banking days to become eligible for payout
• E-wallet payments: 2 banking days to become eligible for payout

We reserve the right to withhold payouts for transactions under investigation for fraud, chargebacks, or other disputes. Such investigations will not exceed 30 days from notice.

All content, features, and functionality of DaliBook's platform are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without our express written permission.

Resort partners retain ownership of their data, content, images, and property information uploaded to our platform. By using our services, you grant us a limited license to use, display, and process this content solely for the purpose of providing our booking and management services.

To the maximum extent permitted by law, DaliBook shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to loss of profits, business interruption, or loss of data.

Our total liability for any claims arising from these terms or your use of our services shall not exceed the total fees paid by you to us in the three months preceding the claim. Resort partners are responsible for the quality of their accommodations and services provided to guests.

Users are prohibited from using our platform for any illegal activities, including but not limited to money laundering, fraud, or facilitating prohibited businesses as defined by our payment partners. Violation of these restrictions may result in immediate account suspension or termination.

Either party may terminate this agreement with 30 days written notice. We reserve the right to immediately suspend or terminate accounts for violation of these terms, fraudulent activity, high chargeback rates, or other reasons that may harm our platform or other users.

Upon termination, your right to use our services ceases immediately, but these terms remain in effect for past transactions. Outstanding balances and pending payouts will be settled according to our standard procedures.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Taguig City, Philippines.

We may update these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of significant changes via email or platform notifications at least 30 days before they take effect.

Your continued use of our services after any changes constitutes acceptance of the new terms. We encourage you to review these terms periodically to stay informed of any updates.

Our payment processing services are provided through our partnership with PayMongo Philippines Inc. This partnership is governed by a separate Payment Solutions Agreement that may have different terms and conditions regarding payment processing, settlement schedules, and termination provisions.

In the event of termination of our payment processing partnership, we will provide at least 30 days notice to affected users and assist in transitioning to alternative payment solutions where possible. Outstanding transactions and settlements will be processed according to existing schedules and terms.
